FMPop Distribution Privacy Policy

FM Pop Music School Pte. Ltd. (“FMPMS,” “we,” “us,” or “our” the service provider of the Service,) take your personal privacy seriously and duly comply with the Personal Data Protection Act (“PDPA”). Our Privacy and Personal Data Protection Policy (the “Policy”), which explains how we use, disclose or otherwise process personal data, as well as other important matters related to your privacy. This Policy applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes.

Personal Data

As used in this Policy: “Personal data” means data, whether true or not, about a user who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.

Depending on the nature of your interaction with FMPMS, some examples of personal data which we may collect from you include your name, contact information such as residential address, email address or telephone number, nationality, gender, date of birth, marital status, photographs and other audio-visual information, employment information and financial information such as credit card numbers, debit card numbers or bank account information.

Other terms used in this Policy shall have the meanings given to them in the PDPA (where the context so permits)

If you are under 18 years of age, you should ensure that you obtain the consent of your parents or legal guardian before using the Platform. If you are a firm, corporation or entity supplying personal data of your partners, directors, shareholders, employees, officers and/or other persons to us, please do ensure that you have obtained their consent and bring this Policy to their attention.

Collection of Data
  1. Information related to personal data:

    When you register as a member of the Service, we may collect your certain information, including, but not limited to, your personal identification information such as name, date of birth, identification number, passport number, and permanent address; your personal contact information such as contact number, email address, and contact address; your personal financial information such as bank account name and account number.

  2. Information related to personal activities on the Platform:

    When you use the Service, we may collect certain information including information about your source of using the Service, technical data such as URL, IP address, operation system data, language and access time, and location information, usage history of the Platform, inquiry information etc.

Use of Personal Data
  1. The data collected under this Policy will be used as follows:

    (1) The basic personal data you provide (such as your name) will be used for the purpose of member identification; the contacted information you provide may be used for contacting you, notifying you update notices related to the Service, and/or other users management and services.

    (2) Information about the scan copy of your identification card or Passport may be used for the Service real name membership audit to determine whether the member account is your real identity.

    (3) Your use and technical data regarding the Service may be used for the purpose of improving the Service, and/or developing new services.

    (4) The financial information you provide will be used for the payment of the relevant amount paid by FMPMS to you.

  2. The data collected herein may be processed and/or used by our third-party service provider and our affiliates or business partners or outside Singapore. We will not use them for any other purposes unless the local laws provide otherwise and will also not disclose them to any third party without your prior consent, unless the laws require so due to material national interests or for the purpose of facilitating law enforcement agencies’ investigations.
Withdrawing Consent
  1. The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request FMPMS to stop using and/or disclosing your personal data for any or all of the purposes listed above by submitting a request in writing or via email to FMPMS's Data Protection Officer at the contact details provided below.
  2. Upon receipt of your written request to withdraw consent, FMPMS may require reasonable time (depending on the complexity of the request and its impact on FMPMS's relationship with you) for your request to be processed and for FMPMS to notify you of the consequences of FMPMS acceding to the same, including any legal consequences which may affect your rights and liabilities. In general, FMPMS shall seek to process your request within thirty (30) business days of receiving it. Upon receipt of your written request to withdraw consent, FMPMS will ensure that its representatives cease using or disclosing your personal data within a reasonable period of such request. However, FMPMS will not inform other organisations to which it has disclosed your personal data of your withdrawal of consent. You may find out which other organisations his personal data may have been disclosed to and give notice to withdraw consent to those other organisations directly.
  3. Whilst FMPMS respects your decision to withdraw your consent, depending on the nature and scope of your request, FMPMS may not be in a position to continue providing its goods or services and shall, in such circumstances, notify you before completing the processing of such request. Your withdrawal of consent does not affect FMPMS's right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws. Notwithstanding anything to the contrary, FMPMS retains the discretion not to delete or destroy any personal data which it may require for its business or legal needs.
Access to and Correction of Personal Data
  1. If you wish to make (a) an access request for access to a copy of the personal data which FMPMS holds about you or information about the ways in which FMPMS uses or discloses your personal data, or (b) a correction request to correct or update any of your personal data which FMPMS holds about you, you may submit your request in writing or via email to FMPMS's Data Protection Officer at the contact details provided in Paragraph 24 of this Policy.
  2. A reasonable fee may be charged for an access request. If so, FMPMS will inform you of the fee before processing your request. Also, if your personal data has been provided to FMPMS by a third party, you should request for the relevant third party to make the access or correction request on your behalf.
  3. FMPMS will respond to your request as soon as reasonably possible. Should FMPMS not be able to respond to your request within thirty (30) days after receiving the request, FMPMS will inform you in writing within thirty (30) days of the time by which FMPMS will be able to respond to your request. If FMPMS is unable to provide you with any personal data or to make a correction requested by you, FMPMS shall generally inform of the reasons why FMPMS are unable to do so (except where FMPMS is not required to do so under the PDPA).
Protection of Personal Data
  1. To safeguard your personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, FMPMS has introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of personal data by FMPMS, and disclosing personal data both internally and to FMPMS's authorised third party service providers and agents only on a need-to-know basis.
  2. You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, FMPMS strives to protect the security of your information and are constantly reviewing and enhancing FMPMS's information security measures.
Accuracy of Personal Data

FMPMS generally relies on personal data provided by you (or your authorised representative). In order to ensure that your personal data is current, complete and accurate, you shall update FMPMS if there are changes to your personal data by informing FMPMS's Data Protection Officer in writing or via email at the contact details provided in this Policy.

Retention of Personal Data
  1. FMPMS may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.
  2. FMPMS will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.
Transfers of Personal Data Outside Of Singapore

FMPMS may transfer your personal data to countries outside of Singapore. If FMPMS does so, your personal data may be stored in external servers that are located out of Singapore, or may be transferred out of Singapore where it is necessary to share your personal data with and between FMPMS's related corporations and business units, and third party service providers. FMPMS is committed to protecting your personal data when it is transferred out of Singapore. Where your personal data is transferred out of Singapore, FMPMS will take reasonable steps to ensure that your personal data continues to receive a standard of protection that is at least comparable to that provided under the PDPA.

Contacting You

If you have provided FMPMS with your Singapore telephone number(s) and has indicated that you consent to receiving FMPMS's marketing or other promotional information by way of your Singapore telephone number(s), then from time to time, FMPMS and its Employees may contact you using such Singapore telephone number(s) even if these telephone number(s) are registered with the "Do Not Call" Registry. You may however let FMPMS know in writing if you does not wish to be contacted by FMPMS at your telephone number(s) for such purposes. For the avoidance of doubt, nothing in this paragraph restricts or prohibits FMPMS from contacting you through any other means (e.g. email or social media), where FMPMS has obtained the consent of you for the collection, use and disclosure of such personal data.

Effect of Policy and Changes to Policy
  1. This Policy applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your personal data by FMPMS.
  2. FMPMS may revise this Policy from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Policy was last updated. Your continued use of FMPMS's services constitutes your acknowledgement and acceptance of such changes.
  3. This Policy constitutes part of the Terms of Service. If you do not agree any part of this Policy or any amended content, please stop using the Service immediately.
Governing Law

This Data Protection Policy shall be governed by and shall be construed in accordance with the laws of Singapore. You hereby submit to the non-exclusive jurisdiction of the Singapore courts.
